Domestic Violence: The Law on Violence in the Family Sphere

Domestic violence, perpetrated within a family or relationship where intimacy, trust, and dependence can transform into tools of control and fear, demands a firm, integrated intervention from the Law, focused on victim protection. This work offers a developed analysis of the phenomenon, articulating its inherent dynamics with the international and European framework, ECHR jurisprudence, and the Portuguese criminal legal regime. Starting from Article 152 of the Penal Code, it examines the protected legal interest, the subjects, the typical conduct, the subjective element, the concurrence of crimes, the public nature of the procedure, protective measures, penalties, social protection, and the State's responsibility.
