General Theory of Civil Law - 2nd Edition

The General Theory of Civil Law plays a structural role in the Portuguese Legal System. It is within its scope that its core components are analysed and conceptualised: (i) persons; (ii) objects; (iii) legal situations; and (iv) legal facts. In this Volume I, the first three are studied.
The analysis developed stems from the practical-applicative nature of Law: it is understood as the Science of resolving concrete cases. This conception presupposes a constant dialogue with the jurisprudence produced by the higher courts.
In addition to the always necessary revisions and updates, we highlight the following changes in this 2nd edition: (i) inclusion of matter relating to the repercussion of time, a systematically more appropriate solution; (ii) inclusion of a point on the attribution of knowledge to persons; (iii) a complete revision of the point relating to the disregard of corporate personality, reflecting the research and solutions advocated in a recent monograph; and (iv) the development of points relating to the expansion of legal personality and acts performed by accompanied adults.
