This work consists of three volumes.
This volume initially addresses the eternal debate on the foundation and legitimacy of constitutional justice. It reviews the most significant historical episodes in the formation of constitutional justice. This evolutionary process resulted in the formation of several alternative models – although not necessarily antithetical – for guaranteeing the constitution, some not yet reducible to the idea of constitutional justice, such as the so-called French model, materialized in concrete systems. The most recent trend towards the hybridization of systems and the loss of heuristic capacity of pure models will be discussed.
Some sections are dedicated to the organic dimension of constitutional justice, as well as to the most universally widespread control processes. The Portuguese system of constitutional justice is focused on, its historical formation and current configuration regarding judicial organization and existing procedural avenues, establishing the necessary normative bridges with the supranational level.
The debate on the alleged deficiencies or insufficiencies of the Portuguese system is discussed, and a brief look is given at the discussion – not strictly legal – regarding the role played in the Portuguese political system by constitutional justice or, more specifically, by the Constitutional Court.
In the second volume, the main focus is on positive Portuguese constitutional procedural law.
The third volume focuses on the effects of the decisions of the Constitutional Court.
