Transnational organised crime is, today, an undeniable reality that confronts the Law and the legitimate exercise of State power. The necessary repression of this phenomenon requires a new approach to the philosophical bases that sustain and legitimize Law as a regulatory system endowed with imperativeness and coerciveness, as well as to the legal dogma regarding the provision for and punishment of the crime of criminal association. The confrontation of organised crime with the Law should not lead to the demand for solutions that, although apparently easy in their formulation and social acceptability, disregard the axiological trilogy of Law: liberty, equality, and human dignity. This was (is) the path we sought to follow.
