Blame After a Finished Pact

Civil liability constitutes one of the most dynamic areas of Private Law, challenged by the evolution of legal relations and the increasing complexity of the interests it is called upon to protect. In this context, the issue of ancillary duties assumes particular relevance. Although traditionally associated with the pre-contractual and execution phases of a contract, these duties can extend beyond the termination of the contractual relationship, raising important questions regarding their dogmatic framework and their respective legal regime. This work offers a critical and systematic analysis of a subject still insufficiently developed in Portuguese legal doctrine, whose theoretical and practical relevance justifies a renewed effort of scientific reflection.
